Nature of service & intermediary status

GETTSECURE RAKSHA PRIVATE LIMITED (CIN U62091KA2026PTC226482) (the "Company") operates strictly as a pure technology marketplace intermediary platform under Section 79 of the Information Technology (IT) Act, 2000. The Company does not own, lease, maintain, or operate a fleet of transport vehicles, nor does it function as a public passenger ride-sharing or ride-hailing carrier. The digital service provided is strictly limited to an on-demand technological matching infrastructure that connects private vehicle owners and commercial automotive networks with independent freelance driving professionals (the "Driving Partner"). Driving Partners register to operate exclusively as independent gig-economy freelancers and freelance business partners under the Code on Social Security, 2020.

Vehicle ownership & statutory compliance

By requesting a Driving Partner via the digital interface, the User explicitly certifies that they hold legal title, registered ownership, or absolute corporate authorization over the vehicle asset profile linked to their active booking. The User guarantees that the vehicle complies fully with all statutory regulations under the Indian Motor Vehicles Act, 1988, maintains an active, non-expired comprehensive motor insurance policy, and possesses valid registration certificates (RC) and Pollution Under Control (PUC) clearances within the active operational jurisdiction.

Co-system pass liability waiver

The User acknowledges that the independent Driving Partner is operating the vehicle under a private contractor arrangement initiated solely by the User. To the maximum extent permitted by applicable law, the vehicle owner assumes 100% civil and criminal liability for all transit operations, road maneuvers, mechanical wear-and-tear, engine breakdowns, structural damage, third-party property damage, or traffic code violations (e-challans) that occur while the vehicle is in transit. The Company shall be held completely harmless against any vehicle asset depreciation, losses, or legal disputes arising enroute.

Indian taxation compliance (GST / OIDAR)

All ecosystem transaction subtotals and platform convenience fees are processed under strict compliance with Indian statutory guidelines. Local point-to-point on-demand driving services and commercial fleet transits completed within the states of Karnataka and Telangana are explicitly itemized as equal CGST (2.5%) and SGST (2.5%) tax splits on all corporate ledgers, digital accounts, and invoices. Premium platform membership subscriptions are classified as Online Information Database Access and Retrieval (OIDAR) services and attract a mandatory 18% GST calculation layer.
